Xaquuqda shaqaaluhu leeyihiin

Shaqaale ahaan xaquuq baad leedahay xattaa haddii:

  • aadan ahayn muwaadan Canadian ah, qof

haaysta ruqsadda degenaanshaha joogtada ah,

ama leh ruqsadda shaqada,

  • aad hadda shaqada biloowday,
  • aad gurigaaga ama qof kale gurigiisa ka shaqeysid,
  • aad degan tahay qof kale gurigiisa aadna iyaga u shaqeysid,
  • ay tahay in aad ka sheqeysid goobo kale duwan wakhtiyo kale duwan si aad howsha u fuliso,
  • shaqada ku qabatid wakhti dhan (full-time), wakhti dhimman (part-time), ama ku-meelgaar ahaan (temporary).

Xattaa haddii aad saxiixday heshiis kontraat ah “shaqsi si madax banaan heshiis loola galay” (independent contractor) weli xaquuq baad shaqaale ahaan u leedahay.

1032939_95257933

 Maxey shaqaaluhu xaquuq u leeyihiin?

Waxaa jira sharciyo ku saabsan:

  • noocyada su’aalaha uu loo-shaqeeyuhu ku weeydin karo intuusan shaqada kuu qorin,
  • saacadaha shaqada,
  • lacagta ugu yar oo lagu shaqeyn karo (minimum wage),
  • mushaarka xilliga fasaxa la qaato, mushaarka maalmaha ciida la qaato, iyo wakhtiga shaqada laga maqan yahay,
  • caafimaadka iyo badbaadada goobta shaqada, iyo
  • waxa aad sameyn kartid haddii shaqada lagaa saaro ama si xun oo laguula dhaqmay daraadeed ay khasab kugu noqotay in aad shaqada isaga tagtid.

Waxaa jira sharciyo kala duwan oo khuseeya noocyada kala duwan ee shaqada. Waxaad u baahan tahay in aad ogaatid waxa ay sharciyadaani ka sheegayaan nooca shaqada aad qabatid. Waxaa suurtoowda in ay arrintaan ka caawiyaan ururada shaqaalaha, hey’adaha beesha qaarkood, iyo kilinikayaasha sharciga (legal clinics).

Maxaan sameeyaa shaqaale ahaan haddii qof uu si lid igu ah ii takooro?

Sharciyada xaquuqda aadamigu waxey leeyihiin loo-shaqeeyeyaashu waa in ayan si adiga lid kugu ah ku takoorin. Haddiise shaqaalaha kale si adiga lid kugu ah kuu takooran, waa in loo-shaqeeyahaagu qaadaa tilaabooyin arrintaan lagu joojinaayo. Takooriddu waxey dhacda markii qof kaa hor istaago shaqo qorid, kuula dhaqmo si aan xaq ahayn, ama shaqada kaa eryo sabab la xiriirta:

  • jinsigaaga ama qoloda aad asal ahaan ka timid,
  • diintaada,
  • da’daada,
  • itaal-la’aantaada,
  • dheddig/lab ahaantaada,
  • qaabka aad u galmootid,
  • xammilanimodaada ama caruur aad leedahay sababteed.

Liiskan waxaa ka muuqda tokoorid badan hase yeeshe noocyadeedo idili kuma ay dhamma.

549243_91098719

Maxaan sameeyaa haddii xaqdarooyin kale aan shaqada dhexdeeda kala kulmo?

Loo-shaqeeyayaashu waa in ay meesha ka saran wixii carqalad ah oo adiga si lid kugu ah kuu takooraya, haddii aysan caddeyn karin in wax ka qabashada arrintaani ay iyaga aad ugu adag tahay. Waxaa arrintaan la yiraahda “maslaxeyn” (accommodation).

Sidaas awgeed, tusaale ahaan, loo-shaqeeyahaagu wa inuu raadiyaa sidii u wax uga qaban lahaa bahidaada dineed. Waxaad u baahan kartaa inaad si goni ah u labisatid, in aad heshid fasax yar oo aad ku tukatid, ama aad ciidaha diiniga ah shaqada ka maqnaatid.

Xaaladaada caafimaad awgeed, waxaad u baahan kartaa in aad ku shaqeysid meelo dadan, ama fadhi, istaag, ama aad soc-socotid.

Marka fasaxa uurku kuu  dhammaado, waxaad xaq u leedahay in aad dib ugu soo noqotid shaqadaadii ama mid u dhiganta.

Kuwaani waa tusaaleeyn guud oo keliya ah. Waa in aad heshaa la-talin sharciyeed oo xaaladaada ku saabsan.

550813_82376093

Maxaan kale oo aan sameyn kara?

Waxaad u baahan kartaa in aad dacwootid haddii loo shaqeeyahaagu ama qof kale oo goobta shaqada u si xaqdaro ah kula dhaqmo ama uusan tixgalin xuquuqahaaga.

Dacwada wakhtigeedu waa xaddidan yahay, sidaas darteed waa inaad isla markaas raadsataa la-talin sharciyeed.

Qoro sidii wax u dhaceen, goormaa, iyo xagee, iyo magacyada qof kasta oo arkay ama maqlay dhacdada.

Waa fikrad fiican in aad had iyo jeer qoratid taariiqaha iyo saacadaha aad shaqeeysay. Waxaad kale nuqul ka reebata dokumeentooyinka kale oo shaqadaada ku lug leh.

Boggaan waxaan kuugu sheegeynaa warar guud oo keliya. Waa in aad heshaa la-talin sharciyeed oo xaaladaada ku saabsan.
